ING’s Financial Markets Derivatives team in Amsterdam is seeking an experienced derivatives and regulatory lawyer to support ING’s derivatives business globally. The role will include advising on complex extraterritorial regulatory reform in the context of financial markets and their services and products.
As Legal Counsel in the Derivatives team you will, among others:
provide real-time advice to stakeholders on regulatory issues, particularly EMIR, OTC Client Clearing and exchange traded derivatives structures and documentation, trade reporting, threshold calculations and regulatory risk mitigation techniques.
advise on OTC derivatives, bespoke transactions financial market products and transactions.
be part of various internal implementing work stream together with members from Credit Risk, Compliance, Operations, Front Office and Value Chain Management, and will actively participate in the translation of legal and regulatory requirements into technical specifications for systems and processes.
be an active member in industry initiatives such as ISDA working groups and monitor global regulatory developments.
Experience and Qualification required:
At least 4 years’ legal practice or compliance experience with a national regulator, in-house or law firm.
Proven knowledge and understanding of key regulations such as EMIR, FATCA, clearing, trade reporting and regulatory risk mitigation techniques. The candidate must be able to demonstrate actual experience and not merely an interest in these subjects.
Previous experience negotiating ISDA master agreements including structured finance ISDAs and credit support annexes would be a plus.
Understanding of financial markets’ products, processes and documentation (ISDA, GMRA, Give-Ups).
Ability to interpret complex statutes and regulations and produce clear, practical guidance.
Strong analytical skills, judgment and energy/enthusiasm.
Strong interpersonal skills.
Excellent verbal and written communication skills in English; Dutch native/German language skill is a plus.
Master’s degree in law/equivalent law qualification (LLM etc.); Dutch legal qualification is a plus.
