Job Description
Contracts Executive (CE) works to drive Business adherence to Services guidelines and policies with regards to Services Agreements. This role supports the Services sales organization by owning the review, negotiation and approval of non-standard contract terms and non-standard contract documents. The purpose of the Contracts Executive role is to drive a healthy business for internal and external customers, to support transactional excellence, and to make sure that Microsoft assets are protected.
Responsibilities include but are not limited to:
• Provide contracting and negotiation support for deals with non-standard contract terms and/or that are contracted on non-standard paper.
Support Services sales and delivery teams in reviewing, recommending creative positioning, negotiating and contracting services deals that have non-standard contract terms, using given empowerments and/or supporting approval of contractual concessions, assuring contractual compliance with Microsoft's and Services policies and risk management requirements. Collaborate with Microsoft’s Legal Counsel and engage as needed directly with personnel in customer’s procurement, legal, and IT functions.
• Perform related SBD readiness and programmatic work.
Participate in or drive programs directed to improve SBD field readiness or implement SBD projects and programs.
• Field training
Train Services IC and management roles on approval policies, contracting guidelines, best practices, tools and processes, including new program features, engagement processes and field empowerment. Subject matter includes policy, contracting and negotiation best practices and customer expectation setting.
• Field consultancy
Provide guidance to Services as well as EPG sales people on contracting- and compliance-related topics, on Microsoft’s contracting policies and business position on major contractual matters, and on approaching customer contracting requests.
• Capture Best Practices & Knowledge Sharing
Capture best practices and contract language, including successful fallback language and negotiating positions, negotiating practices. Sharing of lessons learnt and experience.
Skills/Expertise and Qualifications:
• Contracting and negotiation expertise in the IT professional services industry
• Ability to evaluate contract terms and conditions in RFP / Tender issued by enterprise customers, particularly in government sector, and provide contract response as part of proposal submission
• Contract risk assessment, present and communicate findings and recommendations to Deal Team and Senior Management
• Bachelor's Degree or Master’s Degree (Business, IT and/or Law or related field), and/or equivalent experience
